Purchases made through the Website

Please read these extra Terms and Conditions set out below very carefully. They relate to our e commerce terms and conditions of sale of our driver monitoring schemes and your rights under the distance selling act of 2000.

The Name and marks contained in this website are the fully owned and protected trademarks of RoadDriver Limited and or their Providers and Contributors.  All materials, including but not limited to Textural content, Images, Audio and Video clips, Animation, Diagrams, Photographs, and any and all information of any kind in any form the ("Materials"), incorporated into, published or otherwise exhibited on this Website are protected by copyright or other intellectual property rights and are owned and controlled by RoadDriver Ltd unless otherwise stated.

Prohibited Use:

Any copying, reproducing, republishing, uploading, posting, modifying or transmission or distribution of any Materials is strictly prohibited and will be considered a violation of RoadDriver Limited intellectual property rights and or our Providers and Contributors and could result in legal liability and/or criminal prosecution. You are strictly forbidden to use any automated devices such as computer controlled robots, snoopers or spiders designed to probe, scan or test the vulnerability of our security, authentication and verification systems or to disassemble or reverse engineer computer programmes or software, gather manually or automatically information or monitor materials available through our site. Filing Incident Reports:

By submitting Visitor Content and or Incident Reports to the Website, you agree to represent and warrant that such Visitor Content including Incident Reports shall not contain any dishonest, libelous, defamatory, abusive, threatening, obscene, illegal, unlawful, racist, sexist or other discriminatory comments which could cause offence. Your comments must not in any way identify the person or persons referred too in such Incident Reports other than the vehicle license plate number, manufacturer, make, colour and model of vehicle  All information which you provide to us must be accurate, truthful and should not infringe the rights, including the intellectual property rights (for example, copyright) of any other person and by submitting any information, you confirm that you own or otherwise have the right to use any information which you give freely to RoadDriver to publish at its sole discretion.

This section deals with Terms and Conditions relating to the sale of our road safety schemes and services provided by www.roaddriver.co.uk which is the trading name of RoadDriver Ltd.

This section does not relate to any service or product we provide free to the general public.

These "Terms and Conditions" of sale apply to any order you place through the RoadDriver website at www.roaddriver.co.uk which will subsequently be referred to herein as the "Website". 

All transactions relating to this website are governed by English law and are subject to the non-exclusive jurisdiction of the English courts. We do not accept amendments to these Terms and Conditions.

Please read these Terms and Conditions of Sale carefully for by placing an order through the Website, you confirm that you have read, understood and agree to these Terms and Conditions of Sale in full. If you do not agree to these Terms and Conditions of Sale, you must not order any product or service through the Website.

Electronic communications

When you visit www.roaddriver.co.uk or send e-mails to us, you are communicating with us electronically. We communicate with you by e-mail or by posting notices on the website. Provision of our driver monitoring services 

If you purchase a driver monitoring scheme from us, then we shall use our skill and expertise to carry out the driver monitoring process to a standard equivalent to that of a competent computer professional working in the field of driver monitoring.

In the event of a claim arising relating to the level of skill and judgement applied in the course of providing our driver monitoring service, we reserve at our sole discretion the right to appoint an independent arbitrator to appraise our work carried out in the execution of the driver monitoring service. 

Individual and business customers

If you are not an individual CUSTOMER (sole buyer), you confirm by using our website that you have authority to bind any BUSINESS to our terms and conditions of sale on whose behalf YOU use this website to purchase or order our goods or services.

Individual or business customer details

In order to purchase road safety schemes or services from us you will need to create an individual or business customer account which requires providing certain information and choosing a username and password.

You are entirely responsible for maintaining the confidentiality of your username and password and for all activities which take place under your account. You agree not to disclose your username and password to a third party and agree to notify www.roaddriver.co.uk immediately if you suspect any unauthorised use of your account or access to your username or password.

In no event will RoadDriver Ltd trading as www.roaddriver.co.uk be liable for any indirect or consequential loss or damage whatsoever resulting from the disclosure of your username and or password.

We reserve the right to restrict or remove your access to this website where you breach these terms and conditions without recourse or explanation.

Acceptance of your order

Please note that completion of the online checkout process does not constitute our acceptance of your order. When you place an order for our road safety schemes or services, this will be regarded as an offer by you to purchase our schemes or services subject to our Terms and Conditions.

Accepting your offer to purchase our schemes or services will be at our sole discretion. At this stage in the purchasing process we will send to you an order acknowledgement email detailing the products you have ordered.

Acceptance of your order and the completion of the contract between you and www.Roaddriver.co.uk will take place only upon despatch of the safety stickers, additional material or commencement of the driver monitoring services that you ordered from us unless we have notified you that we do not accept your order or you have subsequently cancelled your order.

All schemes and safety stickers ordered through the Website will remain the property of www.roaddriver.co.uk until we have received payment in full.

Prices and Payment

All prices and charges on this site are in UK pounds. They include any VAT payable, and include delivery charges.

The total cost of your order will be the price of administering our driver monitoring schemes plus your road safety vehicle stickers for a period of one year. The one year countdown period only starts for those safety schemes that you activate by assigning a safety scheme number to an individual vehicle and subsequently uploading the vehicles details to the website. (Full details are contained in “How to administer the Road safety Schemes”)

Details of your order will be set out clearly in your Shopping Basket before you submit your order.

We accept payment by most major credit and debit cards. Payment is deducted when we process your order. During the checkout process, you will be asked to complete your payment details. All fields indicated as compulsory must be completed. Please note for your added security at this stage in the transaction you will be transferred to HSBC’s secured global payment portal where HSBC global payments will collect and store your financial information using their encrypted secure payment mechanism and will only use your financial information in accordance with HSBC’s Privacy Policy.

All card payments are subject to authorisation by your card issuer and we take payment when we accept your order unless you have chosen the invoice me option in the shopping cart.

If your payment is not received and you have already received the safety scheme stickers you ordered from us, you must pay for the safety scheme stickers or return the stickers to us in accordance with reasonable return instructions that we provide to you and in the same condition that you received them at your own expense. If you do not do this within 30 days of the date on which we cancel your order, we may collect or arrange for collection of the safety stickers and associated material at your expense.

We reserve the right to charge you for any and all damage to (or other adverse interference with) any safety stickers that are the subject of an unpaid order.

If we cannot supply you with the safety stickers or driver monitoring schemes that you ordered, we will not process your order, we will inform you of this in writing (including e-mail) and, if you have already paid for the product or service, we will refund you in full as soon as reasonably possible.

Your right to cancel your order

Set out below is our returns and right to cancel policy. It is very important that you read and agree these Terms and Conditions before placing an order with www.roaddriver.co.uk.

This applies to driver monitoring schemes and safety stickers purchased from us. Details of this statutory right and an explanation of how to exercise it are provided below.

If you are a UK/EU consumer, you have the legal right, under the Consumer Protection (Distance Selling) Regulations 2000 to cancel your order within seven working days, normally referred to as the statutory cooling off period.

Following your receipt of our safety scheme stickers or the date on which we begin provision of our driver monitoring schemes. Refunds for orders cancelled under the provisions of the Consumer Protection (Distance Selling) Regulations will be processed in accordance with your legal rights.

If you wish to cancel (or are considering cancelling) a safety scheme or driver monitoring service you have ordered from us, please be aware of the following terms that apply:

No right of cancellation, refund or return exists under the Consumer Protection (Distance Selling) Regulations 2000 once you have used or affixed your safety stickers to a vehicle or any other surface, unless they are defective and you are returning them for this reason.

Damaged or incorrectly supplied road safety stickers

You should check all road safety stickers and materials you receive against your order. If the safety stickers you receive are damaged or incorrectly supplied on delivery then you must note the details of any damage or error in supply on the delivery documentation and inform us (by post, phone or e-mail only) within seven working days of delivery. 

You must return the safety stickers to us as soon as possible after informing us that the safety stickers are damaged or have been incorrectly supplied. Please note that we will not accept the return of any damaged or incorrectly supplied safety stickers where you fail to notify us of this within seven working days of receiving them.

Other cancelled options 

If you want to cancel safety stickers that are not damaged or incorrectly supplied, then you must inform us of this within seven working days, starting the day after you receive the order. 

You must take reasonable care of the safety stickers and associated material that you wish to cancel and not use them. 

Safety stickers should be returned unopened promptly at your cost to our contact address which is clearly shown at the bottom of this page and also on our contact page.

This is not intended to be a full statement of all your rights under the Distance Selling Regulations.

Damage during the course of returning safety stickers 

If you choose to return any safety stickers or associated material to us, we will not be responsible for any loss or damage to them in transit and, for this reason, we recommend that you use a recorded delivery service. 

If returned safety stickers are lost or damaged in transit, we reserve the right to charge you (or not to refund any amounts attributable to) such loss or damage.

Collection 

For certain, larger orders, we may offer to arrange collection on your behalf and, where this is the case, you will be responsible to pay the costs of such collection (which we will notify to you in advance).

If you cancel your order in any of the circumstances set out above save for cancellation under the provisions of the Direct Selling Regulations, we will refund any money paid by you after any safety stickers, which have been delivered to you, are returned to us.

In the case of damaged or incorrectly supplied safety stickers, we may offer you replacement safety stickers. Any refunds given by us will be made to the debit/credit card account provided when you placed your order and will be subject to our right to withhold amounts for products which are damaged on return or for which we arrange collection, as outlined above.

Where we deliver safety stickers to a third party in accordance with your order, you will only be able to exercise this cancellation right if you can return the goods to us (or arrange for us to collect them).

Returns and after sales policy

Unopened goods

We will exchange or refund your purchase up to 28 days following the day of delivery, but it must be returned unopened and in its original packaging. The return must be carried out using one of the three methods described below.

Distance Selling Regulations
If you open the packages to inspect the safety stickers, you can cancel your purchase up to 7 working days* following the day of delivery.

You can cancel your purchase by

  1. posting the safety stickers to our office address which is displayed on our contact page, or
  2. logging in to www.roaddriver.co.uk website and using the Contact Us facility to request that we collect the product, or
  3. telephoning us on 01732-851182 with your order reference number and delivery details to hand.

If cancelling your purchase under the Distance Selling Regulations, your safety stickers must be complete and in an 'as new' condition.

If you have opened the box to examine the safety stickers you must have done so without damaging or marking the stickers or packaging.

The safety stickers must not have been used or fixed to any vehicle or other surfaces and vehicle registration numbers must not have been inputted and uploaded to the www.roaddriver.co.uk website.

The safety stickers plus any material should be returned with the original box and packaging.

If you follow the above, we will issue you with a full refund for the cost of your order. However we reserve the right to retain any charge paid for services which have already begun or been completed. Refunds take 3-5 working days to be credited to your payment card.

Whilst the safety stickers are in your possession you must take reasonable care of them and not use them.

RoadDriver Safety Stickers

DISCLAIMER
Please Note! This legal notice applies to all persons applying or removing RoadDriver Stickers whether paid for or supplied free as part of the RoadDriver safety initiative.

Since RoadDriver is not there to install a customers safety stickers, it is not possible for us to confirm that the safety sticker/s were applied properly or to a suitable clean surface, therefore, we cannot accept responsibility for ANY damage to the safety stickers or any surfaces they are being applied to during installation by the customer. We do not advise application on a re-sprayed painted surface, or on poor quality or rusted paintwork.

If you are not certain about applying the safety sticker, it is your sole responsibility to seek professional help. This applies both to paying customers and those customers who receive our free stickers. 

RoadDriver gives no warranties, express or implied, including, but not limited to, the implied warranties of merchantability, and fitness for the purpose our safety stickers were intended for. RoadDriver Ltd will not be held liable for any damages incurred directly or indirectly on vehicles their operators or on any person employed or otherwise to fix or secure our safety stickers to your vehicle or vehicles.

RoadDriver Ltd cannot be responsible for colour fading or damage to paintwork when safety stickers are removed. Careful removal of our safety stickers from good quality, factory original paintwork, will not damage the paintwork. Please read the advice note on removing safety stickers that came with your order.

Customer Complaints

We never take your custom for granted and will always endeavour to respond to your complaint or query promptly and courteously.

We aim to acknowledge your communication within 24 hours of receiving your complaint or query and would aim to settle the matter within 5 *working days.

*"working days" means all days other than Saturday, Sunday and Public Holidays

Events outside our control

We shall not be liable for delay or failure to perform any obligation under these Terms and Conditions if the delay or failure is caused by any circumstances beyond our reasonable control, including but not limited to, acts of god, war, civil disorder or industrial dispute.

Alteration of Service or Amendments to the Conditions

We reserve the right to make changes to our website, policies, and these Conditions of Use & Sale at any time.

You will be subject to the policies and Conditions of Conditions of Use & Sale in force at the time that you use the website or that you order driver monitoring schemes or road safety stickers from us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you).

If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.
